Attorney Greg Snell has obtained a jury verdict of $18,787,500.00 from an all female jury in Daytona Beach on behalf of a business client. The verdict is by far the highest verdict ever achieved in Volusia County history.
The case involved a business that was sued by a competitor in Kentucky who turned to their insurance carrier, Hartford Insurance of the Southeast, to defend them. Defending the case was prohibitively expensive because of the nature of the case and while the client was confident the case could be won they simply could not afford the cost of defense. Hartford refused the request to defend the suit and the client was left with no practical choice but to settle the case, which they did by paying the competitor a lump sum of cash and agreeing not to compete with them for four years.
The jury awarded $237,500.00 for the lump sum payment plus $18,550,000.00 in lost profits for the four year period of non-competition. The client will also be entitled to attorneys fees, costs and interest, which could substantially increase the recovery. Hartford has expressed an intent to take an appeal. Any judgment will accrue interest at the statutory rate of interest while an appeal is pending.
